Appeal and Judicial Review of Decisions of the Tribunal
You can appeal a final decision of the Financial and Consumer Services Tribunal to the New Brunswick Court of Appeal with leave (permission) of that Court. The request for an appeal is done by a leave to appeal motion. Section 48 of the Financial and Consumer Services Commission Act, S.N.B. 2013, ch. 30 sets out the appeal process. You should also consult Rule 62 of the New Brunswick Rules of Court regarding the appeal process and which is available on the Government of New Brunswick website.
You must also inform the Registrar of the Tribunal if you are appealing a decision of the Tribunal because the Registrar must provide certain documents to the Court of Appeal in accordance with subsection 48(5) of the Financial and Consumer Services Commission Act.
